Photographer Jinga Zhang Loses Plagiarism Case Against Artist

What happened: Singaporean photographer Jinga Zhang sued artist Jeff Dieschburg in Luxembourg court for “ripping off” her work. One of Dieschburg’s paintings, which Zhang saw exhibited at Strassen Contemporary Biennial in Luxembourg last May, closely resembled a cover photo she made for Harper’s Bazaar Vietnam. Dieschburg, who admits he used Zhang’s photo as source material, flipped the orientation and added an earring in his work.
Why it matters: While this case does not involve AI-generated work, Zhang’s arguments are similar to what an artist might bring against someone who feeds a source image into an AI-art generator. Here, the Luxembourg court said the model’s pose in Zhang’s work was not sufficiently “unique” to warrant copyright protection under Luxembourg law.
“The basis of the judge’s ruling was that the model’s pose in my photo is not unique. But how can a photo’s copyright be based on a pose alone? If having a unique pose is the premise for copyright protection of an image, then nearly all portrait works in the world will not have copyright protection.” ~ Jinga Zhang
